The Liberty Bank Visa® Gift Card Terms and Conditions

This is your Liberty Bank Visa® Gift Card Agreement ("Agreement").  These are the terms and conditions governing our issuance and your use of the enclosed Visa® Gift Card ("Card"). Please read them carefully and keep them for your records.  Please sign your Card immediately.  In this Agreement, "you" and "your" mean: (a) the person to whom we issue the Card; (b) the person receiving the Card; and (c) the person using the Card. The terms "we," "us," "our," and "Bank" mean Liberty Bank of Arkansas and its successors, agents, and assigns. 

Card Acceptance:  By accepting and using your Card you agree to these terms and conditions.  You do not have to sign this agreement. 

Card Usage:  The Card allows you to make purchases wherever Visa® debit cards are accepted.  The Card is non-transferable and non-refundable.  Your Card Available Funds are not a FDIC insured deposit. The Card should be used for signature based transactions (swiped as “credit”) and cannot be used for PIN transactions, to obtain cash at ATM machines, or to make pre-authorized regular payments. The Card may not be used for “pay at the pump” fuel transactions.  The unused available balance on your Card does not earn interest and is subject to fees outlined below.  A stop payment cannot be placed on any transaction after it is completed. 

Card Limitations:  The Card is limited to the dollar amount of the gift associated with the Card.  The Card may be used when there is a remaining value on it, up to the amount that remains.  Purchases will be deducted from your Card until the value reaches zero. If the merchant attempts to process the Card for more than the available funds, the transaction may be declined.  If you want to make a purchase that exceeds the amount available on your Card, you may be able to pay the difference with another form of payment, depending on the merchant's policy.  If, for some reason, a transaction that exceeds the value on the Card is completed, you will be liable for the negative balance. When all funds have been depleted from the Card, the Card is not reloadable and cannot be reused.

Certain types of merchants, such as restaurants, gas stations, car rental agencies, cruise lines, hotels and other merchants may obtain an authorization that exceeds the actual amount of your purchase. If the amount of an authorization exceeds the value remaining on your Card, the transactions may not be honored, even though the value remaining on your Card is sufficient to cover the actual amount of your purchase. The secured authorized amount may be held and unavailable for up to three business days. However only the amount the cardholder authorizes will be deducted from the card balance.

Confirmation of Available Funds:  You may confirm your available balance or transactions 24 hours a day, seven days a week at https://www.onlinecardaccess.com/libertybank or by calling us toll free at  877-850-9651.

Fees and Charges:  There are no fees associated with the use of the Card when purchasing goods and services.  A lost, stolen, or damaged card replacement fee of $5.00 will be imposed for the replacement of the Card and will be deducted from the remaining balance.  When the Card has no activity for 6 months it is considered inactive and will be charged a $5.00 fee which is deducted from the card balance on the first day of each month until the balance reaches $0.  Liberty Bank Gift Cards have no obligation to permit a negative balance on the gift card. You will be liable for any negative balance on the Card and will be responsible in remitting payment upon receipt of invoice. 

Expiration: Your Card expires on the expiration date listed on the front of the Card or when the entire value has been exhausted, whichever comes first. After the Card has expired, it is no longer valid. All transactions will be declined.   

Termination: The Card shall remain our property. We may, at any time and without prior notice, cancel your Card and have you return the Card to us. You may terminate your Card by returning the Card to us. Termination of the Card will not affect prior transactions or obligations existing at the time of termination. Upon termination, we will arrange to send you a check for your remaining balance, less outstanding transactions and fees, within six to eight weeks.

Refusal of Card:  Neither we nor any bank or business will be liable to you for failure to honor the Card.

Disputes with Merchants: You agree to make a good faith effort to settle all disputes about purchases you make using your Card with the merchant who accepted the Card.

Returns and Exchanges:  The Bank, their affiliates, employees and agents are not responsible for the services or merchandise purchased with the Card and is not responsible for the return or exchange of merchandise purchased with the Card.  By use of this Card, cardholder agrees that issuer is not liable for any consequential damages, direct or indirect. If cardholder thinks an error has occurred involving a transaction, that error needs to be adjusted and resolved with the merchant at whose establishment the transaction was made. Exchange or return of merchandise purchased in whole or in part with the Liberty Bank Gift Card will be governed by the procedures and policies of each merchant and applicable law. If cardholder receives a credit, the credit may not be added to the available funds for seven business days. Return and refund policies are dependent on the merchant from whom the purchase was made. At the time of any exchange or return, cardholder should present both the merchandise receipt and the Card.

Loss or Theft:  We are not responsible for lost or stolen cards.  You are liable for all transactions that occur on the Card until you report that the Card is either lost or stolen.  You may contact us by calling 877-850-9651 or by writing to:  Liberty Bank of Arkansas, Gift Card Department, PO Box 7514, Jonesboro, AR  72403. 

Foreign Transactions: Transactions conducted in a foreign currency will be converted using a rate selected by Visa from the range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate Visa itself receives, or the government-mandated rate in effect for the applicable central processing date, in each instance plus or minus any adjustment determined by us.

Documentation of Transactions: At the time of purchase, you will receive a receipt for the transaction. Retain the receipt for your records. You will also have access to transactions and your balance at https://www.onlinecardaccess.com/libertybank.

Disclosure of Information to Third Parties: We may disclose information to third parties about your Card or the transactions that you make if it is necessary to complete a transaction, to verify the existence and condition of your Card, to resolve an error or an inquiry as to an alleged error, to comply with a legal subpoena or other mandatory disclosure requirements, or if you give us permission.

Disclaimer of Liability: In providing the Gift Card service to you, we disclaim any duty or responsibility other than those expressly set forth in these Terms and Conditions. The issuer is not liable expressly for the following:

  • If through no fault of ours, cardholder does not have enough money on the Card to cover the transaction; or
  • If the transaction would exceed the cardholder's available funds; or
  • If the terminal or system was not working properly; or
  • If circumstances beyond our control (such as natural disaster) prevent the transaction, despite reasonable precautions that we may have taken; or
  • If there are other exceptions stated in these Terms and Conditions or provided by law. Amendment: We may amend these Terms and Conditions by mailing notice to you at your last address on our records at least 21 days prior to the effective date of any amendment that results in an increased fee or charge, an increase in your liability, a reduction in Card services, or stricter transaction limitations.

Assignment: You may not transfer or assign your Card rights to any other person without our prior written consent. We may assign our obligations to you under these Terms and Conditions without your consent or notice to you.

Severability/No Waiver:If any provision of these Terms and Conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. Our failure to enforce the strict performance of any provision of these Terms and Conditions will not constitute a waiver of our right to subsequently enforce such provision or any other provisions of these Terms and Conditions.

Cancellation:  We retain the right to amend or discontinue the Liberty Bank Visa Gift Card program and these Terms and Conditions at any time and at our discretion. We may cancel your right to use the Card at any time and have you return the Card to us. A check will be mailed to you for the remaining value.

Failure to Make Transfers:  If we do not complete a transfer from the Card on time or in the correct amount, we will be liable for your losses or damages. However, there are some exceptions. We will NOT be liable, for instance:

  • If, through no fault of ours, you do not have sufficient value remaining on the Card to complete the transaction;
  • If the terminal or system was not working properly and you knew about the breakdown when you started the transaction;
  • If circumstances beyond our control (such as fire or flood) prevent the transaction, despite our reasonable precautions.

While we are happy to answer your questions about transactions, please remember that your Card works like cash, and you will be considered to have authorized any transaction by anyone using your Card or Card number.
